Marrakech Wonders General Terms and Conditions

  1. IntroductionThese General Terms and Conditions (hereinafter, “Terms”) govern the use of the website www.marrakechwonders.com (hereinafter, “Website”) and the services provided by Marrakech Wonders (hereinafter, “Company”), whose main activity is the organization of tours and trips.
  2. ServicesThe Company provides guided tours and trip services as described on our Website. All services are subject to availability and may be withdrawn at any time. If your tour or trip cannot be supplied or there are changes to it for any reason, we will inform you as soon as possible.
  3. Booking and PaymentA booking is made with the Company when a) you tell us that you would like to accept our written or verbal quotation, b) you pay us a deposit or full payment, and c) you issue you with a booking confirmation. We reserve the right to return your deposit and decline to issue a booking confirmation at our absolute discretion.
  4. Pricing and Inclusions/ExclusionsPrices listed on the Website are per person unless otherwise specified. Price quotations are subject to change without notice until a booking has been confirmed. Unless otherwise specified, prices do not include any local taxes or use fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.
  5. Cancellations and RefundsCancellation of bookings must be notified to the Company in writing. You are entitled to a full refund if you cancel your booking within 24 hours of receiving your booking confirmation. If you cancel your booking after this period, certain cancellation charges apply.
  6. LiabilityThe Company accepts no responsibility for any sickness, pilferage, labour disputes, machinery breakdown, government restrains, acts of war and terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.
  7. ComplaintsIn the unlikely event that you have any reason to complain or experience any problems with your trip whilst away, you must immediately inform us. Any verbal notification must be put in writing and given to us as soon as possible.
  8. PrivacyYou acknowledge and agree that we may process your personal data in accordance with our Privacy Policy, which is part of these Terms.
  9. AmendmentsThe Company reserves the right to update or alter these Terms at any time and shall post the amended Terms on the Website.
  10. Governing Law These Terms and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of Morocco without giving effect to any choice or conflict of law provision or rule.
  1. Health and SafetyThe client confirms that he/she is physically fit and does not have any condition or disability that could make the tour hazardous. The client must notify the Company of any medical condition or disability which may require special facilities.
  2. InsuranceThe Company strongly recommends that all clients obtain travel insurance covering medical expenses, injury, death, and loss of personal items.
  3. Images and MarketingYou agree that, while participating in any tour, images, photos or videos taken by you or the Company’s staff may be used by the Company – without recourse to you – in any media, for publicity and promotional purposes.
  4. Force MajeureThe Company will not be liable for any failure or delay in performing its obligations under these Terms that is due to a ‘force Majeure event, such as fire, flood, earthquake, storm, hurricane or another natural disaster, war, invasion, the act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or any interruption or any failure of electricity or server, system, computer, internet or telephone service.
  5. SeverabilityIf any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
  6. WaiverNo waiver by the Company of any breach by you of any provision of these Terms shall be deemed to be a waiver of any subsequent breach of that or any other provision of these Terms.
  7. Entire AgreementThese Terms contain the entire agreement between the Company and you relating to the subject matter hereof and supersede any prior understanding or agreements regarding the subject matter.
  8. Confirmation of UnderstandingBy booking a tour, you affirm that you have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.

By booking a trip with us, you agree to be bound by these Terms and Conditions that govern our relationship, the cancellation policy and limitations of liability. You also consent to our use of your personal information in accordance with our Privacy Policy.
